General Terms and Conditions (GTC)

1. Scope of application

These General Terms and Conditions (GTC) apply to all services and products offered by CTG Engineering GmbH (hereinafter “CTG Engineering” or “we”).
They govern the contractual relationship between CTG Engineering and its customers (hereinafter “customer” or “customers”) in Switzerland and abroad.
Any deviating terms and conditions of the customer shall not be recognized unless CTG Engineering expressly agrees to them in writing.
Unless otherwise agreed, these GTC apply to both private customers (B2C) and business customers (B2B).

2. Information on this website

The information, service descriptions and prices published on the website www.ctg.engineering are provided for general information purposes.
Technical changes, errors or misprints are reserved.
All offers are subject to change and non-binding.
CTG Engineering reserves the right to change or remove website content at any time without prior notice.

3. Prices

All prices are stated in Swiss francs (CHF) and include the statutory value-added tax (VAT) of 8.1%.
Price changes may be made at any time, in particular in the event of adjustments to statutory charges, material costs or delivery costs.
The price applicable to the customer is the price at the time of the order or order confirmation.

4. Conclusion of contract

A contract is concluded as soon as the customer places a binding order for a service or product from CTG Engineering and this order is confirmed by CTG Engineering in writing, by e-mail, or verbally.
In the case of online orders, the contract is deemed concluded upon dispatch of the order confirmation.
The presentation of services and prices on the website does not constitute a legally binding offer, but merely a non-binding invitation to request a quotation or to place an order.
Quotations are valid for 28 days from the date of issue, unless expressly agreed otherwise in writing. After expiry of this period, CTG Engineering is no longer bound by the stated price or conditions.

5. Payment options and retention of title

Private customers (B2C): credit card, PayPal, Twint or cash payment.
Business customers (B2B): bank transfer (payment term net 14 days), credit card, PayPal or Twint.
Until full payment of all receivables has been made, the service provided or the goods delivered shall remain the property of CTG Engineering GmbH.

6. Delivery, duty to inspect, notice of defects and returns

Services are provided as agreed and subject to availability.
Delivered products must be inspected by the customer immediately upon receipt. Any defects or deviations must be reported in writing within five (5) working days.
After expiry of this period, the delivery shall be deemed approved.
Returns require prior consent from CTG Engineering. Returns sent carriage forward / unpaid will not be accepted.

7. Right of withdrawal

Under Swiss law (Swiss Code of Obligations), there is no general right of withdrawal or rescission.
CTG Engineering does not grant any voluntary right of return unless expressly agreed in writing.

8. Warranty and guarantee conditions

CTG Engineering grants a warranty of 12 months from the provision of the service for all work performed in the area of performance enhancement and custom tuning.
For an additional charge, CTG Engineering offers an additional 12-month guarantee for the entire drivetrain and engine control system, provided that:
- the vehicle is not older than 5 years, and
- has a maximum mileage of 100,000 km.
Customers receive the Back-to-Stock service free of charge for 12 months from performance optimization, i.e., reprogramming back to the vehicle’s original data status.
CTG Engineering assumes no liability or warranty whatsoever for damage to the vehicle, drivetrain, or other components that occurs during or as a result of dyno performance measurements.
Use of the dynamometer is at the customer’s express risk.

9. Liability

CTG Engineering shall be liable exclusively for damage caused by gross negligence or unlawful intent.
Any further liability—especially for indirect damage, consequential damage, loss of profit, data loss, or third-party claims—is expressly excluded.
CTG Engineering assumes no responsibility for the content of external websites referenced via links.

10. Data protection

CTG Engineering treats all personal data confidentially and uses it exclusively for contract processing as well as for its own marketing purposes and for sending newsletters.
No disclosure to third-party providers or external service providers takes place, except where legally mandatory obligations apply.
By using the website and making use of the services, the customer agrees to the described use of data.

11. Severability

Should individual provisions of these GTC be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
In place of the invalid clause, a provision shall apply that comes closest to the economic purpose.

12. Further provisions

CTG Engineering reserves the right to amend these GTC at any time.
Swiss law shall apply exclusively, to the exclusion of Swiss private international law (PILA/IPRG) and the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction is Lucerne, Switzerland.
